These Terms of Service ("Terms") constitute a legally binding agreement between you and Novatrax Global LLC ("Novatrax," "Company," "we," "our," or "us"). By creating an account, downloading any of our applications, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, by notifying you via email. Continued use of our services after changes become effective constitutes your acceptance of the revised Terms.

Eligibility

You must be at least 13 years of age to use our services. If you are between 13 and 18, you may only use our services with the consent of a parent or legal guardian. By using our services, you represent and warrant that you meet these age requirements and have the legal capacity to enter into this agreement.

Our services are intended for use in jurisdictions where they are lawful. You are responsible for ensuring your use of our services complies with applicable laws in your jurisdiction.

Subscriptions & Billing

Free Tier

Each of our products offers a free tier with access to core features at no cost. Free tiers do not require a payment method and have no time limit unless otherwise specified.

Paid Subscriptions

Paid subscription plans are billed on a monthly or annual basis as selected at the time of purchase. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis at the applicable subscription rate.

Cancellation & Refunds

You may cancel your subscription at any time from within your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date. We do not offer refunds for partial billing periods except where required by applicable law.

Price Changes

We reserve the right to change subscription pricing with at least 30 days' advance notice. Continued use of the paid service after a price change constitutes your acceptance of the new price.

All content, features, and functionality of our products — including but not limited to text, graphics, logos, icons, software, and AI models — are the exclusive property of Novatrax Global LLC or its licensors and are protected by applicable intellectual property laws.

You retain ownership of any content you submit to our services (such as health logs, journal entries, or business data). By submitting content, you grant us a limited license to use, store, and process that content solely for the purpose of providing our services to you. We do not claim ownership of your data.

Our trademarks, product names (OutsideSafe, Ru, EstimIO, Sky), and the Novatrax Global name and logo may not be used without our prior written consent.

Our products include AI-powered features (including Sky AI in OutsideSafe, pattern intelligence in Ru, and cost calculation in EstimIO). You acknowledge that:

Health Disclaimer

Important: Our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Information provided by OutsideSafe, Ru, or any other Novatrax product does not constitute medical advice. Always consult a qualified healthcare professional before making decisions based on health-related information from our products.

In any emergency, contact your local emergency services (911 in the US) immediately. Do not rely on our products for emergency safety decisions.

Disclaimers of Warranty

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or data provided through our services.

Section 11

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOVATRAX GLOBAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Novatrax Global LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through our services.

Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason including violation of these Terms.

You may terminate your account at any time by contacting us at info@novatraxglob.com or by using the account deletion feature within the applicable product. Upon termination, your right to use our services ceases immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of incorporation of Novatrax Global LLC, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the applicable jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We may revise these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, by sending an email notification. Your continued use of our services after any changes become effective constitutes your acceptance of the new Terms.
